Terms of Service
Effective Date: April 12, 2026
These Terms of Service govern your use of the Thyme app and related services. Please read them carefully. By creating an account or using Thyme, you agree to these terms.
1 Acceptance of Terms
By downloading, installing, or using the Thyme application (the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, you may not use Thyme. Your continued use of the Service after any updates to these Terms constitutes acceptance of the revised Terms.
These Terms constitute a legally binding agreement between you and Thyme ("Thyme," "we," "us," or "our"), the operator of the Thyme application and the website usethyme.app.
2 Description of Service
Thyme is a household grocery planning application that provides:
- Smart grocery list management and purchase history tracking
- Receipt scanning and extraction using AI
- Barcode scanning for product identification
- Allergen and ingredient analysis based on product databases
- FDA food recall alerts based on your purchase history
- Nearby grocery store discovery and crowd-sourced busyness reports
- ThymePro premium features (subscription required)
Thyme is a productivity and planning tool. It is not a medical device, healthcare provider, or nutrition counseling service.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time with reasonable notice. We will not be liable for any modification, suspension, or discontinuation of the Service.
3 User Accounts
Eligibility
You must be at least 13 years old to use Thyme. By creating an account, you represent that you meet this age requirement. If you are between 13 and 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Account Accuracy
You agree to provide accurate, current, and complete information when creating your account, and to keep that information up to date. Providing false information, including a false age, is a violation of these Terms and may result in immediate account termination.
One Account Per Person
Each individual may maintain only one Thyme account. Creating duplicate accounts to circumvent restrictions, suspensions, or subscription requirements is prohibited.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at hello@usethyme.app if you suspect unauthorized access to your account. Thyme is not liable for any loss resulting from unauthorized use of your account.
Account Deletion
You may delete your account at any time from Profile → Delete Account. Deletion permanently removes all your data from our systems. This action cannot be undone.
4 Acceptable Use
You agree to use Thyme only for lawful purposes and in accordance with these Terms. You agree not to:
- Scrape or harvest data — use automated scripts, bots, spiders, or other tools to extract data from Thyme's APIs, databases, or user interface
- Abuse the Service — send an unreasonably high volume of requests, attempt to overload our servers, or interfere with the Service's normal operation
- Share credentials — share your login credentials with others or allow others to access your account
- Reverse engineer — decompile, disassemble, or attempt to derive the source code of any proprietary part of the Service
- Circumvent security — attempt to bypass authentication, access other users' data, or probe for vulnerabilities
- Misrepresent identity — impersonate another person or create accounts under false pretenses
- Violate laws — use the Service in any way that violates applicable local, state, national, or international law
- Transmit harmful content — introduce viruses, malware, or other malicious code into the Service
Violation of these rules may result in immediate account suspension or termination at our sole discretion.
5 ThymePro Subscription
Pricing
Auto-Renewal
ThymePro subscriptions automatically renew at the end of each billing period (monthly or annual) at the then-current subscription price. You authorize Thyme to charge your payment method on file for each renewal period unless you cancel before the renewal date.
Cancellation
You may cancel your ThymePro subscription at any time from your account settings or by contacting us at hello@usethyme.app. Cancellation takes effect at the end of your current billing period. You will retain access to ThymePro features through the end of the period for which you have already paid. Thyme does not offer prorated refunds for unused portions of a billing period, except where required by applicable law.
Free Trial
If Thyme offers a free trial period, your subscription will automatically convert to a paid subscription at the end of the trial unless you cancel before the trial ends.
Price Changes
We reserve the right to change subscription pricing. We will provide at least 30 days' notice of any price increase via email to your registered address before the change affects your subscription.
Refunds
All payments are generally non-refundable except where required by law. If you believe you were charged in error, contact us within 14 days of the charge at hello@usethyme.app.
6 Allergen & Health Disclaimer
Thyme is not a medical device and does not provide medical advice. Allergen and ingredient information displayed in Thyme is sourced from third-party product databases (including OpenFoodFacts and Google Gemini AI) and is provided for general informational purposes only.
Always read the actual product label before consuming any food item, regardless of what Thyme displays. Product formulations, ingredient lists, and manufacturing processes change without notice. Database records may be incomplete, outdated, or inaccurate.
Thyme cannot guarantee that allergen information is complete or accurate. Cross-contamination risks, "may contain" warnings, facility-sharing disclosures, and other allergen-related information may not be reflected in our data sources.
Do not rely solely on Thyme to make food safety decisions for yourself or others with food allergies, sensitivities, or dietary restrictions. Individuals with severe or life-threatening food allergies should consult a qualified healthcare provider or allergist.
Thyme, its operators, and its service providers are not liable for any allergic reaction, adverse health event, or other harm arising from reliance on allergen or ingredient information displayed in the app. Use of Thyme's allergen features is entirely at your own risk.
By using Thyme's allergen and ingredient features, you acknowledge that you have read and understood this disclaimer.
7 FDA Recall Information
Recall alerts are informational only. Thyme surfaces FDA recall data from the openFDA public API to help you identify potentially affected products you may have purchased. This service is provided as a convenience — not as a substitute for official FDA communications.
Thyme's recall alert feature has the following limitations:
- Not comprehensive: Recall alerts depend on data available in the openFDA database at the time of the query. Not all recalls may appear, and there may be delays between an FDA announcement and its appearance in the database.
- Product matching is approximate: Recall matches are based on product names and descriptions in your purchase history. They may produce false positives (flagging a safe product) or false negatives (missing an affected product).
- Not a substitute for official sources: For authoritative and complete recall information, visit the FDA website at fda.gov/safety/recalls or sign up for FDA recall alerts directly.
Thyme is not liable for any harm resulting from a failure to surface, or a delay in surfacing, recall information. If you are concerned about a specific product, always check official FDA sources directly.
8 Intellectual Property
The Thyme application, including its design, code, logo, trademarks, and content (excluding user-submitted content), are owned by Thyme and are protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Service without our express written permission.
Your Content
You retain ownership of the content you create in Thyme — your grocery lists, household notes, and other user-generated data. By using the Service, you grant Thyme a limited, non-exclusive, royalty-free license to store, process, and display your content solely as necessary to provide the Service to you. We do not use your personal content to train AI models or for any other purpose beyond operating the Service.
Feedback
If you submit feedback, suggestions, or ideas about Thyme, you grant us the right to use that feedback for any purpose without compensation to you.
9 Limitation of Liability
To the fullest extent permitted by applicable law:
- Thyme provides the Service on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- Thyme does not warrant that the Service will be uninterrupted, error-free, or completely secure.
- Thyme's total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the total amount you paid to Thyme in the 12 months preceding the claim, or (b) $10.00 USD.
- In no event will Thyme be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, business interruption, or personal injury, even if Thyme has been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so the above limitations may not apply to you in full. In such cases, Thyme's liability is limited to the maximum extent permitted by law.
10 Termination
By you: You may stop using Thyme and delete your account at any time from Profile → Delete Account.
By Thyme: We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or if continued access poses a risk to other users or our systems.
Upon termination: (a) your right to use the Service ceases immediately; (b) if you initiated termination, we will delete your data per our Privacy Policy; (c) provisions of these Terms that by their nature should survive termination — including intellectual property rights, disclaimers, and limitation of liability — will survive.
If your account is terminated for cause, you are not entitled to a refund of any prepaid subscription fees.
11 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Georgia, United States of America, without regard to its conflict-of-law principles.
Any dispute arising from or relating to these Terms or your use of the Service that cannot be resolved informally shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Georgia. You consent to the personal jurisdiction of those courts.
Informal Resolution
Before filing any legal claim, you agree to first contact us at hello@usethyme.app and give us 30 days to attempt to resolve the dispute informally. We will try to do the same with you before initiating any action.
Changes to Terms
We may update these Terms from time to time. We'll notify you of material changes by email at least 14 days before they take effect. Continued use of the Service after the effective date of any revised Terms constitutes your acceptance of the changes.
